Eligibility

1. This Promotion is open to all registered members of the Esso Smiles Driver Rewards programme (“Smiles”) including Esso Smiles Private Hire, Esso Smiles Taxi and Esso Smiles Bus, Esso foodpanda and Last Mile Smiles cardmembers, except Esso Fleet cardholders. (“Eligible Smiles Members”).
2. To enter the Lucky Draws, Eligible Smiles Members have to fill up their latest particulars at least once on www.EssoSmiles.com.sg/promotions/EssoLuckyDraws2023 (“Eligible Participant”) from 9 January 2023 to 31 March 2023 (“Promotion Period”).
3. Unregistered Esso Smiles card will not qualify for the Lucky Draw. Registration of the classic Smiles card can be done at: https://www.essosmiles.com.sg/member/register.
4. For registration of the Esso Smiles Private Hire card, Esso Smiles Taxi card and Esso Smiles Bus card, Esso foodpanda card and Esso Last Mile Smiles card, please complete and submit the respective hardcopy application form to any Esso service station. Application may take up to 10 working days.

Promotion Period

5. The Promotion is valid from 9 January 2023 to 31 March 2023 (both dates inclusive).

Promotion Mechanics

6. During the Promotion Period, every gross spend of $60 in a single receipt with a valid Smiles card or a Smiles-linked credit card* on Esso Synergy™ fuels at any Esso service station in Singapore (“Qualifying Spend”) will entitle the Eligible Participant to the following lucky draw chances by fuel grade (“Lucky Draws”):
   1. Esso Synergy Supreme⁺ - 5 (FIVE) Lucky Draw chances will be allocated.
   2. Other Esso Synergy fuels (Extra/Regular/Diesel) - 1 (ONE) Lucky Draw chance will be allocated.
   3. Double Lucky Draw chances will be allocated in (i) or (ii) listed above when a fuel purchase is made with a valid DBS Credit/Debit cards and POSB Debit cards
   
   

   *A “Smiles-linked credit card” refers to a credit card which is linked to an Esso Smiles Driver Rewards account.

   Example:

   • A gross spend of $60 on Esso Synergy Supreme⁺ with a valid DBS/POSB Debit/Credit Card: 5 chances x 2 = 10 Lucky Draw chances earned
   • A gross spend on Esso Synergy Supreme⁺ with all other payment modes: 5 Lucky Draw chances earned
   • A gross spend of $120 on Esso Synergy Extra with a valid DBS/POSB Debit/Credit Card: 2 chances x 2 = 4 Lucky Draw chances earned
   • A gross spend of $120 on Esso Synergy Extra with all other payment modes: 2 Lucky Draw chances earned

7. To enter the Lucky Draws, Eligible Smiles Members will have to:
   1. Swipe a valid Esso Smiles card at the point of purchase to record the purchase or use a valid Esso Smiles-linked credit card for payment of the purchase during the Promotion Period. If the Esso Smiles card is not swiped at the point of purchase or if an Esso Smiles-linked credit card is not used for payment of the purchase, no Lucky Draw chances will be allocated.
   2. Complete a one-time Lucky Draw registration by filling out requested fields with valid input at www.EssoSmiles.com.sg/promotions/EssoLuckyDraws2023 during the Promotion Period for all Qualifying Spend during the Promotion Period to be considered for the Lucky Draw.
   3. Consents under the PDPA to the collection, use and disclosure of the Winner’s personal data by/to EMAPPL and their agent or vendors of and such other third party for the purpose of the Promotion, and confirm that he/she has read and agrees to be bound by the terms of the General Notification On Personal Data Collection, Use & Disclosure for Esso Smiles Members, a copy of which can be found on https://www.essosmiles.com.sg/about-smiles/general-notification-on-personal-data. For avoidance of doubt, missing fields or invalid inputs will be disqualified.
   
   

   Eligible Smiles Members must ensure particulars entered in the Lucky Draw form (www.EssoSmiles.com.sg/promotions/EssoLuckyDraws2023) matches the particulars registered on their Esso Smiles portal for Qualifying Spend to be retrieved. Particulars on the Smiles portal can be checked and updated at https://www.essosmiles.com.sg/member/login.

8. Calculation of Qualifying Spend is based on the transaction date of the gross spend made at Esso service stations.
9. Lucky draw chances accumulated are non-transferable and cannot be combined with the Lucky Draw chances accumulated by any other Eligible Participant.

Selection of Winners

10. There will be a total of 388 winners for the electronic Lucky Draws (“Winner(s)”), consisting of the following Lucky Draw prizes (“Prize(s)”):

    There is no limit to the number of entries, but each Eligible Participant is eligible to win only one prize.

11. The Lucky Draws will be conducted on 3 March 2023 for Lucky Draw #1 and 25 April 2023 for Lucky Draw #2. (“Draw Dates”). Eligible entries from 9 January to 12 February 2023 will qualify for Lucky Draw #1 and eligible entries from 13 February to 31 March 2023 will qualify for Lucky Draw #2.
12. Unless EMAPPL notifies otherwise, the Lucky Draws will be conducted in the presence of an external auditor on the above Draw Dates at 11am (or on such other dates as EMAPPL may determine at its sole and absolute discretion) at 1 HarbourFront Place, HarbourFront Tower One, Singapore 098633 or at such other venue as may be determined by EMAPPL.
13. Winners will be notified by EMAPPL and/or its appointed contractors through email at their registered email address and contacted via telephone (provided that a valid telephone number is given and captured in www.EssoSmiles.com.sg/promotions/EssoLuckyDraws2023 regarding the Prize collection details and for their consent to disclose or publish their information on the Esso Smiles website. In the event that EMAPPL and/or its appointed contractors is/are unable to contact any Winner for any reason through this first phone call, EMAPPL and/or its appointed contractors will make a further one (1) attempt to contact the Winner during office hours (9.00am – 6.00pm) over two consecutive days from the first call made. In the event that all such attempts are unsuccessful or if the Winner does not provide us with his/her consent for his/her information to be published on the Esso Smiles website, EMAPPL reserves the right and has the absolute discretion to award the Prize to the next reserve winner drawn by EMAPPL.
14. The results of both Lucky Draws #1 and #2 will be published on Esso Smiles website (www.EssoSmiles.com.sg/promotions/EssoLuckyDraws2023).
15. Winners must produce his or her email, phone number and Esso Smiles card/Esso Smiles-linked credit card where applicable for verification purposes before the Prize is issued.
16. EMAPPL shall not be responsible or liable for any defect or malfunction in the Prize and/or for any loss, injury, damage, harm suffered or incurred or in connection with the receipt, use or enjoyment of the Prize by any person.

Prizes

17. Prizes collection for Lucky Draw #1 is by 7 April 2023 and Lucky Draw #2 by 2 June 2023, or within one (1) month of the Winner being successfully notified. If the Winner of the Prize does not acknowledge the Prize he/she has won by the end of such stipulated period, EMAPPL reserves the right and has the absolute discretion to award the Prize to the next reserve Winner drawn by EMAPPL.
18. Any Lucky Draw Prize unclaimed by 25 April 2023 for Lucky Draw #1 and 23 June 2023 for Lucky Draw #2 will be forfeited and will be dealt with at the sole discretion of EMAPPL.
19. By accepting the prize, the Winner agrees to be photographed and allows EMAPPL to use his/her name and image for publicity purposes in connection with the Promotion without any further compensation and/or further notification.
20. All prizes cannot be exchanged for cash, other denominations or other goods/services, and are subject to prevailing terms and conditions of use.
21. EMAPPL reserves the right to, at any time and in its sole and absolute discretion, replace and/or substitute the Prizes(s) with any other item of its choosing.
22. EMAPPL makes no warranties or representations (whether express or implied) on the quality, value, merchantability or suitability with respect to the Prize. EMAPPL will not be liable or responsible for the quality, service or any defect/malfunction of the Prize and/or any loss, injury or damage that may be suffered or incurred by any person in connection with the Prize or the use of the Prize. The Winners and/or any other persons who benefit from the Prize shall accept and enjoy the Prize at their own risk.
23. Any dispute about the value, quality, condition or service standard of the Prize must be resolved directly with the respective manufacturer, merchants and/or suppliers of the Prize.
24. Any enquiries and redemptions regarding the Promotion should be directed to EMAPPL. Agents of the manufacturer, merchants and/or suppliers are not a participant in or sponsor of this promotion.
25. Selected prizes will be redeemed via a letter with the Prize redemption code at EMAPPL’s redemption center. In the event the Prize is not redeemed within the indicated period of the letter, EMAPPL will not be liable or responsible for the Prize (which will be deemed forfeited and will be dealt with at the sole discretion of EMAPPL).

Participation and Personal Data

26. By participating in this Promotion, Eligible Cardmembers are subject to these Terms and Conditions. The Eligible Cardmember shall consent and/or is deemed to have consented, to the collection, use, and disclosure of his/her Personal Data as set out in the clauses below, or as may be set out in any subsequent revised versions of the same:
    1. EMAPPL may disclose the Eligible Cardmember’s Personal Data in accordance with the provisions of the PDPA (including all subsidiary legislation made thereunder), or where otherwise required by law.
    2. The Eligible Cardmember also agrees that ExxonMobil may use the Personal Data to provide the Eligible Cardmember with marketing materials relating to fuels-related promotions or any services available at any or all of the Esso Stations, its loyalty programmes, discount card programmes, bank card programmes, private label card programmes, fleet card programmes and other petroleum-related programmes developed by ExxonMobil from time to time, as well as marketing materials relating to any convenience store promotions at any or all of the Esso Stations (collectively, "Marketing Materials"). EMAPPL may transfer the Personal Data to the Specified Third Parties for the purpose of providing Marketing Materials to the Eligible Cardmember. EMAPPL will not disclose the Personal Data to other third parties for marketing by such third parties without the Eligible Cardmember's consent.
    3. The Eligible Cardmember may require ExxonMobil or any of the persons stated in Paragraph (b) not to use the Personal Data for direct marketing purposes, and in such event, the said Cardmember will no longer be eligible to participate in the Lucky Draws. The Eligible Cardmember may also choose to opt-out of receiving the Marketing Materials after the Promotion Period by calling the Esso Smiles Customer Service hotline at 1800-300-8888 during its operating hours or through other modes notified to the Eligible Cardmember. The Eligible Cardmember will cease to receive the Marketing Materials within thirty (30) days after receipt of his/her request to opt out.

Other Terms and Conditions

27. EMAPPL shall not be responsible or liable for any claim, loss or damage whatsoever or howsoever arising out of or in connection with the Promotion or the Prizesawarded under the Promotion.

29. In addition to the terms and conditions set out herein, the Esso Smiles Driver Rewards programme’s Terms and Conditions and the General Notification On Personal Data Collection, Use & Disclosure for Esso Smiles Members shall apply. 30. The terms and conditions for this Promotion may be revised from time to time at EMAPPL’s sole discretion without prior notice.
31. EMAPPL’s decision on all matters relating to this Promotion shall be final and binding. EMAPPL reserves the right not to enter into any correspondence or communication with any party in relation to such decisions.
